Why Are Repubs Trying To Make Gay Marriage A Federal Issue Instead Of A State Issue?
In 2004 & 2006 they tried pushing these federal constitutional amendments to ban gay marriage.
Why can’t they just leave it to the states? Why can’t they follow the 10th amendment and enforce state rights?

I’m a republican and live in a state with a republican governor[Jodi Rell]Ct.It was added to the ballot on Nov.4th 2008 and passed .No one is or has objected to.Or objected to changing our sodomy laws to comply with it.Why has California had it on their ballot twice and both times it was voted no -why do the Dems then want bring it to the Supreme Court and not just keep it in state ?
Hmm….that’s funny, last I heard it was the liberal gay marriage supporters who wanted to make this a federal issue and are trying to take it to the SCOTUS with the hope that it will require every state to recognize it whether they want to or not after California chose to exercise its state right to make the decision that gay marriage would not be legalized in that state. Yet, it’s supposedly the REPUBLICANS who want to make this a federal issue instead of a state issue……Okay…..
As I remember, the federal amendments to ban gay marriage were struck down both times, and justifiably so, as it SHOULD be each state’s right to decide for itself, per the 10th amendment, which is exactly the argument gay marriage supporters who opposed the amendment were making at the time of it, that it wasn’t the federal government’s place to get involved in that and it should be each state’s entitlement to make the decision for itself. But now those same people are throwing a fit because California, like most of the states has chosen not to legalize it as of yet so they want the federal courts to revoke California and every other states’ rights to make individual decisons on gay marriage and just legalize it nationwide under the order of the feds. Apparently, states are only entitled to decide the gay marriage issue for themselves if they elect to let gay marriage supporters have their way. From what I gather, the gay marriage advocates don’t really care about what power the issue is left to, they only care that it’s left to the power that lets them have what they want, constitutionally or not. So, tell me again, who it is that can’t just leave it to the states and can’t follow the 10th amendment and enforce state rights?
Because Republicans need something “to galvanize the base”. Look at Cheney; against Gay Marriage as long as he had to get elected, but now that he is out of office, comes out in support. The Republicans have fallen deeper and deeper into a pattern of “Scare the people into doing what we want.” A scared public will do anything to feel safe, even sign away their freedoms.
Instead of talking about the sanctity of marriage, the government should get out of the marriage business entirely, and just issue liscences for Civil Unions to anyone who wants them, regardless of gender. Then the couple can decide if they want to get married in a church. And churches can decide who they wish to serve, or leave on the side of the road.
The real reason is that gays are the last safe target for intolerance.
Realistically, the Republican Party has been the party of intolerance for at least the last 100 years. Not just racism, but homophobia, nativism and xenophobia, and even religious intolerance. They have instigated, encouraged and exploited every kind of intolerance.
But more recently they see that this no longer works for them. Minority populations are growing rapidly in certain key swing states that the Republicans need. So they are trying to change their image to one more inclusive. This means laying off blacks and hispanics. So they need some other ‘public enemy’ to protect us from. And that’s the Gay Agenda.
But that’s not working either, because the trend for the last 40 years now has been towards more and more acceptance of gays.
And it -is- a national issue! The way it will be solved is that the US Supreme Court will declare that gays are entitled to the same rights as any other group of citizens. That’s what it will take to settle the matter once and for all. This is how the question of miscegenation was settled, and ‘sodomy’ and even abortion. Once the USSC decided, that was about it.
And I believe it will happen too, perhaps not -this- Supreme Court but sooner than you might think.
It shouldn’t be a Federal Issue OR a State Issue.
Separation of Church and State.
The initial campaign involved the disparity in State/Federal benefits b/n hetero/homo UNIONS of which the State recognizes for tax/incentive purposes. Had they stuck w/ that fight, they would have won b/c there are differences and it’s discrimination anyway you look at it.
Instead, it turned into a battle to redefine the word marriage, a ceremony which originated in the churches. If Christians were in fact Jesus like, they might consider entertaining a broader adaptation of the word. If not, create a gay-friendly church a “marry” whoever you want — the state recognizes gay unions so the point it moot at the State level.
Thank you, come again.
whatever is passed in congress, the 10th ammendment is gives them the right to ignore any federal law. it is what the court says that stays forever.
it is the other way around. liberals are trying to buy the courts that way they dont have to depend on voting to legislate. basically what republicans did, was to prohibit gay marriage to become a federal thing. democrats hate state rights because they always lose. which is what happened in california. americans in general dont want gay marriage.
Because of the possibility that the US Sup. Ct. might legalize gay marriage with an interpretation of the 14th Amendment of the US Constitution. In case you’ve forgotten, the Sup. Ct. struck down 13 state “sodomy laws” in 2003, just months before the Mass. court legalized gay marriage in that state.
The people have spoken and find gay relationships abhorrent. It has nothing to do with state, federal or local. It has to do with common morals, and decency. Why should gays own everything and have additional rights just because of whom they choose to sleep with?
We can’t keep trying to bring this country down, no wonder we have so many problems.
Only Bush and Neocons and religious rightists. Real conservatives would leave it to the states, liberals also support that. But don’t forget there are also those who are trying to legalize gay marriage nationwide, like the lawyers from Bush v. Gore.
because we vote against it here in CA and they allcry for justice. We need a nationwide ban to keep them from illegally circumventing the State constitutions with the threat of national allegiance. They want the states to be wrong, that’s why….
Why did a democrat pass the only anti gay federal law ever passed ?
When Clinton passed the Defense of Marriage act ?
Why does your democrat president want to deny gay people the right to marry ?
because civil rights are wining the state to state fight, if reps. make it a FED issue and win, it would become the law of the land and overule local state gov.
It is a federal issue. The United States Constitution mandates equal protection under the law. There is no exception to this for gays.
They can’t stand the thought that there are any gay marriages anywhere in this country. It doesn’t matter that is has no real effect them- whether next door or across the country. So much for getting government out of people’s lives.
What’s going on here? Since when do libs argue for states rights? Oh yeah, just like Republicans- when it suits their agenda.
Its their way or the highway. To bad there are like 7 Repubs in the United States ………so nobody really cares.
Just like any disease, you need to control it and keep it from spreading.
Right! Just like in California, huh?
Riding the Hershey Highway is disgusting in the states or at the federal level.
